§ 11.10.030. Boat docks.

  • No boat dock or pier, swimming dock, pier or platform, or other similar accessory building in the water or on the shoreline shall be constructed without first obtaining a building permit signed by the Building Official. The application for such permit shall be made on a form furnished by the City of Vandalia, which the applicant shall supplement with any plans, specifications and other information as deemed necessary by the Building Official. All structures shall be completed within twelve (12) months from the date of issuance of the permit. The Building Official shall be allowed to inspect the work at any stage of construction, and all completed structures must be approved by the Building Official. (Ord. 1992-8-17-E)

    (a)

    Permanent Boat Docks South Side Lots and Subdivisions. No permanent boat dock shall be build except in accordance with the following rules:

    A.

    All private boat docks shall be unenclosed.

    B.

    No boat dock, swimming pier or platform shall extend more than twenty-four (24) feet from the shoreline at normal water level (elevation five hundred twenty-five (525)), be more than twenty-four (24) feet in width, nor extend more than four (4) feet above normal water level.

    C.

    No boat dock shall be within twelve (12) feet of any side lot line.

    D.

    All material shall be pressure treated.

    E.

    The docks shall be covered with two-inch planking and a two-inch slant.

    F.

    Vertical posts shall be set at not to exceed five-foot intervals. The shore side vertical posts shall have a minimum diameter of three (3) inches and shall be driven a minimum of eighteen (18) inches into the soil. Lake side posts shall be a minimum of four (4) inches in diameter and shall be driven a minimum of two (2) feet into the soil.

    G.

    All materials shall be securely nailed and constructed in a workman like manner.

    H.

    Custodians of residential lots may erect a boat house along the shore line in a manner whereby no enclosed portion of the boat house shall extend beyond the normal shore line (lakeward) nor shall any part of the boat house project more than eighteen (18) feet past the normal shore line (inward) of the lot on the lake side. The floor space of the enclosed portion of the boat house shall not exceed one-third ( 1/3 ) of the total floor space of the boat house and dock combined.

    I.

    Floating boat docks are allowed by variance only.

    J.

    A permanent boat dock shall become the property of the City of Vandalia when the lease terminates.

    (b)

    Permanent Boat Docks-North Side Annual Lease Camping Lots. No permanent boat dock shall be built except in accordance with the following rules:

    A.

    All private boat piers or docks shall have no roofs, be unenclosed, and shall have the slip portion parallel to the shoreline.

    B.

    No boat dock shall extend more than five (5) feet from the shoreline at normal water level (elevation five hundred twenty-five (525)) nor extend more than four (4) feet above normal water level.

    C.

    The dimensions of the dock shall not exceed twenty (20) feet in length nor four (4) feet in width.

    D.

    All materials shall be pressure treated.

    E.

    The docks shall be covered with two-inch planking and a two-inch slant.

    F.

    Lots side by side may have connecting docks with a maximum total length of forty (40) feet.

    I.

    A permanent boat dock shall become the property of the City of Vandalia when the lease terminates.

    J.

    A portable boat lift with a canopy top of canvass, vinyl, or like material is permissible and shall not be a violation of this section. Said canopy top shall be removed by November 1 of each year and may not be re-installed until March 1 of the succeeding year.

    (c)

    Floating Boat Docks-North Side Annual Lease Lots. No floating dock or pier may be constructed and put in place except in accordance with the following rules:

    A.

    All private boat piers or docks shall have no roofs, be unenclosed, and shall have the slip portion parallel to the shoreline.

    B.

    No boat dock shall extend more than ten (10) feet from shore at normal water level (elevation five hundred twenty-five (525) feet).

    C.

    The maximum elevation of the dock shall be five hundred twenty-seven and one-half (527.5) feet and the minimum elevation of the dock shall be five hundred twenty-six and one-half (526.5) feet.

    D.

    The dimensions of the dock shall not exceed twenty (20) feet in length nor four (4) feet in width.

    E.

    Styrofoam shall be used as a sole floatation material. (Ord. 1980-6-16-C)

    F.

    A sufficient quality and quantity of floatation material shall be used so that the top surface of the dock is parallel to the surface of the lake during "no wake" conditions and extends above the surface of the lake a minimum of fifteen (15) inches at all points. (Ord. 1980-6-16-C)

    G.

    Sufficient anchoring devices must be used to insure proper mooring of the dock so that its only movement is to raise or lower with the elevation of the lake. (Ord. 1980-6-16-C)

    H.

    All floatation docks and all parts thereof except anchoring posts or devices shall be removed from the water by November 1 of each year and shall not be returned to the water for use until March 1 of the following year. (Ord. 1980-6-16-C)

    I.

    All floating docks stored on lake property shall be stored and securely fastened at an elevation in excess of five hundred thirty (530) feet above sea level. (Ord. 1980-6-16-C)

    J.

    All materials shall be pressure treated other than corner anchoring posts.

    K.

    All materials shall be securely nailed and constructed in a workman like manner.

    (d)

    Annual Lease Lot Boat Docks. Lessees of annual lease lots on the North side of Lake Vandalia shall be subject to the directions of the Lake Committee with regard to the maintenance, repair, rehabilitation, reconstruction or removal of piers, docks and docking facilities, and appurtenances. Said lessees shall, within thirty (30) days of receiving written notification by the Lake Committee, undertake such action or steps as may have been specified by the Lake Committee. The failure of a lessee to carry out and fulfill directions of the Lake Committee with regard to such matters shall be and constitute a basis for the City Clerk to refuse to renew the lessee's lease for the following year. In the event a lessee shall fail or refuse to fulfill the written directions of the Lake Committee with regard to required maintenance, repair, rehabilitation, reconstruction or removal of piers, docks and docking facilities, and appurtenances, the Lake Committee Chairman shall so advise the City Clerk, and the City Clerk shall refuse to issue a lease to the lessee.     (e)

    Lot 2 of Probst Subdivision #2 Boat Dock. Lot 2 of Probst Subdivision #2 shall be permitted to a single dock permit. The right to a single dock permit for Lot 2 of Probst Subdivision #2 shall terminate forthwith upon (1) any attempt to subdivide or otherwise divide Lot 2 of Probst Subdivision #2, and not division thereof shall be entitled to maintain or construct a dock facility; or (2) any use of Lot 2 in violation of the then provisions of the Ordinances of the City of Vandalia pertaining to Zone 1, Single-Family Residences on Lake Vandalia.     (f)

    Lot 1 of Probst Subdivision #2 Boat Dock. Lot 1 of Probst Subdivision #2 shall be permitted to a single dock permit. The right to a single dock permit for Lot 1 of Probst Subdivision #2 shall terminate forthwith upon (1) any attempt to subdivide or otherwise divide Lot 1 of Prost Subdivision #2, and no division thereof shall be entitled to maintain or construct a dock facility; or (2) any use of Lot 1 in violation of the then provisions of the Ordinances of the City of Vandalia pertaining to Zone 1, Single-Family Residences on Lake Vandalia, or any failure to comply with the other restrictions, provisions and requirements of Zone 1, Single-Family Residences. Application for a boat dock shall constitute acceptance of the rights and benefits provided by the adoption of this title and shall henceforth and for the balance of the term of the lease cause Lot 1 of Probst Subdivision #2 to be subject to the conditions and restrictions pertaining to Zone 1, Single-Family Residences lots together with all applicable requirements and other affirmative obligations thereto appertaining, including but not limited to the annual assessment.     (g)

    Removal of Boat Docks. All boat docks and piers failing to meet the approval of the Lake Committee shall be removed at the owner's expense. (Ord. 1970-2-2-A)
